There is a difference between Marketing, Advertising, Promotions, Sales and Public Relations!

I’m soooooooooooooo going to explain this, later.  I just wanted to get your attention on what is coming up next. Being that I specialize in Marketing, I believe I’m more annoyed with the people who assume that marketing, advertising, promotions, sales and public relations is all the same; and, instead of educating themselves, proceed to tell you what they “think” those words mean.  People stick everything in the “Marketing” category when this is far from what is the truth. Nothing is more bothersome, than Corporate America calling a department Sales and Marketing thus adding to the confusion. I will explain this in more detail at a later time so stay tuned!

So I posed this question to general everday folks and some people actually got it right! So that I don’t make this post too long, I’m going to explain each in few sentences or less. Here goes …

Marketing is the planning of how something is to be sold.  It is the process of how goods or services move from concept to the consumer.

Advertising is the fluff that makes the consumer want to use the goods or services.  It is a tool used to market.  Advertising communicates the message of the brand or service.

Promotions keeps the goods or services relevant to the consumer. Constant mentioning in the press, advertising or sales campaigns. Promotions are not always paid for services it could be free. Something to engage the consumer. Ongoing Advertising, Sales and PR = Promotions!

Public Relations is considered one of the primary elements of promotions. It is simply keeping the product or service constantly in the “face” of the consumer. Elaborates on why this product or service is important to the consumer. This is usually done through various mediums (methods) such as print, radio, tv, online, etc.

Sales has the consumer purchase your goods or services through your Marketing, Promotions and Public Relations efforts. Sales is cultivating prospective buyers, in a particular market segment/niche and conveying the features, advantages and benefits of a product or service to the prospective buyers; then closing the sale.

Note that Publicity is different from Public Relations as you aren’t able to define the message you want to convey to your possible consumers as you do with Public Relations.

I do hope this helps get those back on track! I hear the most miss use of all these terms by various people.  I hope this is helping you all who read this blog!

Employer Identification Number (EIN) – Got One? Need One? Don’t think you need one?

Ok so some folks don’t pay business taxes or taxes in general for that matter. I totally understand that but just because you are small and may not have employees doesn’t mean you don’t need an EIN. Most people use it to keep their personal taxes and business taxes separate.

Sad part about this whole thing is the fact that this is the one item when starting a business you can get free!  YES YOU NEED ONE!

To obtain an EIN and get immediate confirmation apply online at www.irs.gov.

What is the difference between a copyright, patent, trademark, service mark, certification mark and collective mark?

It truly amazes me the business owners I come into contact with that have no idea what the differences are between a copyright, patent, trademark, service mark, certification mark and collective mark.  Matter of fact, some people don’t even realize there is  a difference. This I find to be a tad bit sad because if you had the desire to start a business why didn’t you have the same desire to learn what in the hell you are talking about?! This goes for people in all fields but I seem to see it more in the entertainment field. I guess they assume they can just get a lawyer after thy are successful. I wonder if it ever occurs that the brand they built can be gone in 2 seconds if they are using a name that is legally owned by someone else?

Right now, I will just keep it brief and I can elaborate later once more people start visiting this blog (giving myself some incentives). I’ll go into detail later on the general cost of obtaining these marks and rights. Many would be shock to know they don’t need a lawyer all the time to take care of this. Simply a computer and web access.

Copyright – Obtained to protect works of art, such as literature, music, web content, etc. Just because you put Copyright on your material doesn’t always mean it is protected.

Patent – Obtained to protect and invention or idea. When it is an idea it is considered intellectual property. Usually, you will have to submit documents explaining your idea.

Trademark – Obtain for a product/tangible item that you intend to sale or use to sale something. This is the most common term used incorrectly. Just because you use TM doesn’t mean it is trademarked. (i.e. artist name, brand of clothes)

Service mark – Obtained to distinguish services of one provider over another. For example, someone could be a caterer and the other be butcher who has a service mark.

Certification mark – Obtained so that someone other than the owner of the mark may use it.

Collective mark – Obtained so that those a part of a group or association may us it. Like those are are members of the Cancer Society or work at different chapters and they want to print posters with the logo on it.

Music Monday – Ay Jay?

In the spirit of the twitter trend #MusicMonday, I’m giving y’all some music! I’m pretty amazed at this kid’s sound. Ay Jay hails from the South Carolina and at the age of 16 he seems to be getting quite a buzz.  They are pushing a single “Lock You Down” but I think “I Like It, I Love It” is a better track. Word on the street is that some labels are taking a liking to this kid. Not to mention, Rell, has something to do with the songwriting on this track.  For those who don’t recall, Rell, was the 1st R&B artist signed to Roc-a-fella Records and is the lyrical genius behind Usher’s hit “Here I Stand“.
